TERMS OF SALE (2026 Edition)

1. About Us

We are PHOX REFILL LTD, a company registered in Scotland (Company No. SC844343) with registered office at Clyde Offices, 2nd Floor, 48 West George Street, Glasgow, G2 1BP (“we”, “us”, “our”).

These Terms of Sale govern the purchase of products from www.phoxwater.com.

If you purchase via Amazon or another third-party marketplace, the terms and policies of that marketplace may also apply.

 

2. Eligibility

 

By placing an order you confirm that:

 

(i)                           You are at least 18 years old; and

 

(ii)                        You are legally capable of entering into a binding contract.

 

3. Formation of Contract

 

3.1 Product listings on our website constitute an invitation to treat.

 

3.2 A contract between us is formed only when we send you an order confirmation email. If we are unable to fulfil your order (including due to stock unavailability discovered after confirmation), we will notify you as soon as possible and refund any payment taken for the unavailable product(s).

 

3.3 We reserve the right to refuse or cancel orders where:

 

(i)                           There is an obvious pricing error;

(ii)                        We suspect fraud or misuse;

(iii)                      Products are unavailable.

 

If we cancel after payment has been taken, we will issue a full refund.

 

4. Product Description & Performance

 

4.1 Our water filtration jugs and refill cartridges are designed to reduce certain impurities in tap water as described on the product page.

 

4.2 Performance may vary depending on local water composition, usage patterns, and maintenance.

 

4.3 Our products are not medical devices and are not intended to diagnose, treat, cure or prevent any disease.

 

4.4 Any statements relating to water quality, sustainability or environmental impact are based on product design and intended use assumptions.

 

5. Intended Use

 

5.1 Products must be used in accordance with the instructions provided.

 

5.2 We are not responsible for issues arising from:

 

(i)                           Misuse;

(ii)                        Failure to replace filter media as recommended;

(iii)                      Use outside normal domestic conditions.

 

6. Price & Payment

 

6.1 Prices are displayed in GBP and include VAT where applicable.

 

6.2 Delivery charges are shown at checkout.

 

6.3 Payment is taken at the time of order unless otherwise stated.

 

6.4 We accept payment via the methods displayed at checkout, including Klarna.

 

6.5 Where you choose Klarna or another buy-now-pay-later provider, you enter into a separate agreement with that provider and their terms apply.

 

6.6 Credit is subject to status and eligibility. We are not responsible for credit approval decisions made by Klarna or another buy-now-pay-later provider.

 

7. Delivery

 

7.1 We aim to dispatch orders within 1–2 working days.

 

7.2 We will deliver products within 30 days of contract formation unless otherwise agreed. Delivery timeframes are estimates only.

 

7.3 Risk in the goods passes to you upon delivery.

 

7.4 Ownership to goods passes once full payment has been received.

 

Failed Delivery

 

5.6 You are responsible for providing accurate delivery details.

 

5.7 If delivery fails due to incorrect information or failure to accept delivery, we may charge reasonable re-delivery or storage costs.

 

5.8 If we cannot contact you to re-arrange delivery, we may cancel the contract and refund the product price less reasonable costs incurred.

 

International Delivery

 

5.9 Deliveries outside the UK may be subject to customs duties, taxes or import charges. These are your responsibility.

 

8. Consumer Right to Cancel (UK Customers)

 

If you are a consumer purchasing for personal use, you have the right to cancel within 14 days of receiving your goods.

 

8.1 To exercise your right to cancel, you must notify us clearly (email is sufficient).

 

8.2 You must return goods within 14 days of cancellation.

 

8.3 You are responsible for return postage unless goods are faulty.

 

8.4 We will refund:

 

(i)                           The price paid for the goods; and

(ii)                        The standard delivery cost (but not any premium delivery option chosen).

 

8.5 Refunds will be made within 14 days of receiving returned goods.

 

Hygiene Exception

 

8.6 For health and hygiene reasons, sealed refill filter granules and similar consumable items cannot be returned if unsealed after delivery. [note: check re recycling of granules]

 

9. 30-Day Goodwill Returns Policy

 

In addition to your statutory rights, we offer a 30-day goodwill return policy for unused products.

 

This does not affect your statutory rights.

 

10. Faulty Goods

 

10.1 Nothing in these Terms limits your rights under the Consumer Rights Act 2015.

 

10.2 If goods are faulty, misdescribed or not fit for purpose, you may be entitled to repair, replacement or refund.

 

11. Business Customers

 

If you are purchasing in the course of business:

 

(i)                           The 14-day cancellation right does not apply.

(ii)                        Liability is limited as set out below.

 

12. Subscription Purchases

 

Where you purchase products on a subscription basis, Schedule 1 (Subscription Terms) applies to the extent applicable.

 

13. Liability

 

13.1 Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability which cannot be excluded by law.

 

13.2 Subject to clause 13.1:

 

(i)                           Our liability shall not exceed the price paid for the relevant product.

(ii)                        We are not liable for indirect or consequential loss.

 

13.3 This does not affect your statutory consumer rights.

 

14. Force Majeure

 

We are not liable for failure to perform obligations caused by events beyond our reasonable control.

 

15. Governing Law

 

These Terms of Sale and any non-contractual obligations arising out of or in connection with them are governed by English law.

 

You may bring proceedings in the courts of England and Wales.

 

If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts.

SCHEDULE 1 – SUBSCRIPTION TERMS

These Subscription Terms apply where you purchase products on a recurring subscription basis through www.phoxwater.com (the “Site”).

They form part of and supplement our Terms of Sale.

1. Subscription Overview

1.1 When you select a subscription option, you agree to receive recurring deliveries of the selected product at the delivery interval you choose (for example, every 30, 45 or 60 days).

1.2 Subscriptions renew automatically on a rolling basis until cancelled.

1.3 By purchasing a subscription, you authorise us to charge your selected payment method at the chosen interval for:

(i)         The subscription price displayed at checkout (including any subscription discount); and

(ii)      Applicable delivery charges.

1.4 The subscription frequency, price and applicable discount will be clearly displayed before you complete checkout.

2. Billing & Auto-Renewal

2.1 Your payment method will be automatically charged prior to each scheduled dispatch.

2.2 You will receive confirmation of each renewal order by email.

2.3 It is your responsibility to ensure your payment details are accurate and up to date.

2.4 If payment fails, we may retry payment or suspend your subscription until payment is successfully processed.

3. Cancellation

3.1 You may cancel your subscription at any time by:

(i)         Logging into your customer account;

(ii)      Using the link provided in your subscription confirmation email; or

(iii)    Contacting our customer support team.

3.2 Cancellation must be made before the next renewal payment is processed to prevent that renewal charge.

3.3 If you cancel after renewal payment has been taken but before the goods have been dispatched, we will refund that renewal payment.

3.4 If goods have already been dispatched, cancellation will apply to future renewals only.

3.5 There is no minimum subscription term unless expressly stated at checkout.

4. Subscription Pricing & Discount

4.1 Subscription products may be offered at a fixed discounted price compared to one-off purchases.

4.2 The discount applies only while the subscription remains active.

4.3 If you cancel and later resubscribe, the subscription price may differ from your previous rate.

5. Consumer Cancellation Rights

Each subscription delivery constitutes a separate contract for goods.

If you are a consumer, you have statutory rights under the Consumer Contracts Regulations 2013 to cancel within 14 days of receiving each delivery, subject to the hygiene exception for unsealed consumable products as set out in our Terms of Sale.

6. Changes by Us

6.1 We may change subscription pricing or terms by giving reasonable notice.

6.2 If you do not agree to any change, you may cancel before the next renewal date.

7. Suspension or Termination by Us

We may suspend or terminate your subscription if:

(i)         Payment fails repeatedly;

(ii)      You breach our Terms of Sale or Website Terms;

(iii)    We reasonably suspect misuse or fraudulent activity.
